A Spouse Visa is designed to help families reunite by allowing the non-citizen spouse to legally reside in the country with their partner.
The UK Spouse Visa allows individuals who are legally married to British citizens or persons with settled status in the UK to join their partner and live together in the country.Over time, successful applicants can become eligible for Indefinite Leave to Remain (ILR), typically after five years of continuous residence under this visa route.
To qualify for a UK Spouse Visa, both partners must meet certain criteria
Your partner must be either a British citizen, someone settled in the UK, or have other qualifying immigration statuses.
Both of you must be at least 18 years old.
The relationship must be legally valid, exclusive, and genuine.
You must have met your partner in person.
You must intend to live together in the UK on a long-term basis.
Any previous relationships must have legally ended.
You must meet the financial and accommodation criteria.
You must satisfy the English language requirement unless exempt.
A British or Irish national living in the UK.
A person with Indefinite Leave to Remain (ILR), settled status under the EU Settlement Scheme, or permanent residence.
A Turkish Businessperson or Worker with status under Appendix ECAA.
A person granted refugee status or humanitarian protection.
Both partners must be aged 18 or over at the time of application.
Employment or self-employment.
Pension income.
Specific state benefits received by the UK-based sponsor (e.g., Carer’s Allowance, Disability Living Allowance).
Other legitimate sources of income or savings.
You may not need to meet the income threshold. However, you must still show that adequate financial support and accommodation are available without relying on public funds.
Is owned or legally occupied by you or your partner.
Offers adequate space for everyone who will live there.
Meets public health standards.
Passing an approved English language test at CEFR Level A1 or higher (unless applying for an extension, where Level A2 or B1 may apply).
Holding an academic qualification taught in English and recognized by UK NARIC.
Being a national of a majority English-speaking country.
If applying from outside the UK, the initial visa is granted for 33 months.
If applying from within the UK, you are granted 30 months.
Both can be extended for an additional 30 months, leading up to 5 years of residence.
Meet the financial and relationship requirements.
Pass the English language test at CEFR Level B1.
Pass the Life in the UK Test.
Have not breached immigration laws.
Switching into this visa category from within the UK is possible, provided the applicant is not in the UK as a visitor or without valid leave. You must still meet all standard requirements related to relationship, finances, accommodation, and English.
